Bashan is floating images of a bike they claim to be manufacturing, that looks exactly like the Honda Varadero XL125. Actually it is an image of a real XL 125 Varadaro they are using, tsk tsk.
The bike is advertised by Bashan on their Spanish language website.

Then it also is being advertised on chinamotorworld.com as a BS250-18, with an image that seems to show a Yamaha v250 altered into an image of the Honda.

Its interesting, in how messed up are these people, how they spend so much time altering images but then offer up some of the most distorted images of models they actually do make and sell.
Like this one on Bashan’s Russian website of a CG125, it so blurry, they spend much more effort in deceiving the then spend when offering up the more legitimate models?

Finally, some of the Chinese manufacturers figured out that they have V2 engine on the shelf and that it can be installed on something that is not cruiser or chopper.

If they are interested in cheating to make money then why not just copy currencies, it is also easier and cheaper? If rules of law do not matter then why bother with all the details, just copy money. If somebody has some thing you want just hit them over the head and take it.

In most cases the engines are not right protected only the design of the cases the ornamental design is right protected, most are off patent for the mechanical designs. They simply have to alter and most do the designs of the casing on the engines. As for making exact of nearly exact copies that is totally illegal and in most every country. If the manufactures that being the original manufacturers maintained international patent on the ornamental designs. I highly doubt that Honda did not or does not maintain the patents on the Varadero. The Lifeng SPT 350 likely violates several design patents.
Shame on Jawa for not knowing and respecting that, they are party to that when offering this model. Do not assume that these issues go unaddressed, they likely are and do through legal letters. Many can agree or disagree but there are processes of law that have to be respected and processes to change them as well. But simply ignoring the laws has repercussions.

That bike has design elements that violate a Honda design, the fuel tank, the seat and side covers are copied. An ornamental design patent is a set of elements leaving some out of the set does not negate liability in the use of the remaining elements. Putting a brand name on it makes the owner of that brand party to the liability for selling what is a stolen design.
The laws are different in different regions but most subscribe to a common set of laws. In some countries it is a civil violation in others criminal. The recoverable damages typically do not have a limit on time to recover losses as damages, since most countries document sales with registrations, stealing and selling designs is likely to get many into trouble. Being blatant widespread and even the common complacency in markets does not make it legitimate.
