Ok lmao figured it out. The previous owner was drinking when he handed the bike over.. He forgot which position was off... Then said all the left was... I've been doing. thinking it was off.....

I'm guessing someone has fiddled with the wiring.. Have the wiring schematic at home so will have a look and pull out the ignition and see what I can figure out.

Ended up figuring it out. New battery had a dead cell. Didn't think that would be the problem as I had just purchased the battery and was working.

Forgot to add it did turn on and start again after that stop at the servo and then went OK for a while and was cutting off again just cruising along few times and had to clutch in and out to restart...

Now my piece of crap won't start up a few days after putting a new battery in.. Was able to clutch start before putting new battery in.. New battery in and was able to walk up and start it no dramas....

OK so had a look around and I see what your talking about now. Located the ECU on my bike and found out it is a 'Delphi Sec'.

From all the articles I could find you are right. EFI bikes need ECU...
