A short should blow a fuse.

You are getting a open somewhere in the electrical system when you are riding and because of weight shifting when braking the open is being closed and the lights come back on.

The lights are on when you are sitting still and do they go out if you accelerate? If you just coast to a stop after the lights go out do they come back on?

Finding the problem is going to be fun. I would check all the electrical connections starting at the battery. Could be a bad internal connection in the battery.

sitting still on the stand the lights are off, only come on when brake is applied.so no motion involved.Only fuse I know of is the one in the battery box on the hot wire.I will check that one . Upon acceleration they would dim down a bit,but fluctuate.bright /dim/bright/dim..then brakeing they are real bright.

The main fuse should be ok. If it was blown then you would not be able to start the scooter.

So sitting on the stand and revving the engine does not cause the fluctuation in the lights?

Motion is affecting the circuit because you said on acceleration the lights change intensity.

Is the taillight (not brake light ) off when the headlight is off?

Seems like you are getting a back circuit to your lights through the brake light switch. So something in the headlight/tail light in not supplying power.

Does your owner's manual have a wiring diagram?

Does your owner's manual have a wiring diagram? I will check that once I get home.

Funny thing about this is that I have split headlights. One bulb is always brighter (left side) than the other (right). In fact the difference is very drastic. The left side is bright as it should be,but the right is very dim.Now when I flip the high beams on,the right gets a little brighter, and the left remains almost the same..or at least i cannot tell the difference. It was like this before they decided to go out completely without apllying the brake. Now I had noticed that the lights did gain a significant amout of brightness when i was sitting at a traffic stop with the brake engaged, but it never really made me wonder much. Then after last night and the lights going out..it really seems off the wall to me.

Did you check taillight is on when headlight switch is on? Maybe let some mechanic check the bike? it is a simple task.

The system's positive is supplying power via fuses and switches to the power consumers (light, starter, ...) and leads back via the frame (ground) to the negative to close the circuit.
Light combinations, e.g. the tail light case, houses two or more lights from different circuits. The brake light is powered via the micro switches of the hand and foot levers, the rear light via the switch on the handlebar. Both lamp's have a connection to the negative (ground), most likely via the frame.
As you describe your case, it seems to be a problem of the ground connection inside the rear light assembly or it's connection to the frame (negative). Check this ground connection of the tail and front light assemblies.
