This is crazy. (Well, TIC I guess.) Also a little scary! I can't see how it could be any more than 10% your fault. As everyone has said, the fence is there to tell people not to cross the road there, Surely if someone then chooses to cross there; it's their fault.
I know most of us are quite well off by average standards, but 40,000rmb is not small change.
